Terms & Conditions

 

Please read carefully. These Terms & Conditions form a legally binding agreement between you (the client) and Boswell Wildlife Photography. By paying a deposit or making a booking you confirm that you have read, understood, and agreed to all of the following terms. If you have any questions before booking, please do not hesitate to contact us.

 

1.  Bookings & Deposits

​

A reservation is confirmed once a completed booking form and the required non-refundable deposit have been received by Boswell Wildlife Photography. Confirmation of your place will be sent to you in writing by email.

Provisional bookings may be held for up to 14 days pending receipt of a completed booking form and deposit. After this period the place may be released without further notice.

 

Deposit amounts
​

The deposit required to secure your place is as stated on the relevant tour or workshop page on our website at the time of booking. All deposits are non-refundable under any circumstances.

 

Balance payment

​

The full balance is due no later than 12 weeks prior to the departure or start date. You will receive a payment reminder in advance of this date. Where a booking is made within 12 weeks of departure, the full amount is payable at the time of booking.

Unless written notice of cancellation is received before the balance due date, the balance remains payable in full. Once the final balance has been paid the total amount is non-refundable.

 

2.  Cancellation Policy

Cancellation by you

​

If you need to cancel your booking for any reason, you must notify Boswell Wildlife Photography in writing as soon as possible. The following policy applies:

​

  • More than 12 weeks before departure: deposit is forfeited; no further liability.

  • Within 12 weeks of departure where the full balance has been paid: the full amount is non-refundable.

  • No refunds will be made for unused portions of a tour, workshop, or one-to-one once it has commenced.

 

Cancellation charges apply because ground services, accommodation, guide fees, permits, and logistical costs will already have been secured and paid in advance on your behalf.

We reserve the right to cancel any tour, workshop, or one-to-one in exceptional circumstances, including but not limited to insufficient bookings, force majeure events, or safety concerns. In such cases you will be offered either a full refund of monies paid to Boswell Wildlife Photography, or the option to transfer to an alternative date or tour of equivalent value. We cannot accept liability for any consequential losses such as flights, accommodation, or travel costs booked independently.

 

Important: We strongly recommend booking any associated travel arrangements (flights, hotels, car hire) only after your tour place has been formally confirmed in writing by us.

 

3.  Transfers & Postponements
​

If you are unable to attend on the booked date you may request a transfer to another available date, subject to availability and provided that written notice is given at least 8 weeks before the original start date. Only one transfer per booking may be requested without an administration fee. A transfer does not affect the non-refundable nature of any monies already paid.

If your transfer request is made with less than 8 weeks' notice, an administration fee may apply. Please contact us to discuss your circumstances and we will do our best to accommodate you wherever possible.

All prices are quoted in pounds sterling (GBP) and are based on costs, exchange rates, and supplier tariffs current at the time of publication. Boswell Wildlife Photography reserves the right to apply a surcharge should costs increase due to factors beyond our reasonable control, including but not limited to currency fluctuation, fuel levies, government taxes, or statutory increases imposed by suppliers.

We will give you as much notice as possible of any surcharge and will always endeavour to absorb minor increases where we can. If you do not wish to pay a surcharge applied in accordance with this clause and choose to cancel, no refund of monies previously paid will be due.

Prices include only the items specified in the individual tour or workshop description. Unless otherwise stated, prices do not include flights, travel insurance, visas, gratuities, or items of a personal nature.

 

5.  Itinerary & Programme Changes

​

Boswell Wildlife Photography reserves the right to alter, modify, or substitute any part of an itinerary where circumstances beyond our control make this necessary. This may include (but is not limited to) adverse weather, access restrictions, changes in wildlife behaviour, transport disruption, or advice from local authorities.

Where a significant change is necessary prior to departure we will notify you as promptly as possible. Minor adjustments made in the field in the interests of safety, wildlife welfare, or photographic opportunity do not constitute a significant change and no liability is accepted for these.

 

6.  Wildlife & Photographic Results
​

All of our tours and workshops are conducted in wild and natural environments. Wildlife is inherently unpredictable and Boswell Wildlife Photography cannot guarantee sightings of any particular species, nor that photographs of any specific quality or subject will be obtained.

Our itineraries and species lists are based on historical experience and the best available knowledge at the time, but are provided as a guide only. No guarantee of specific sightings or photographic outcomes is made or implied. No refund or compensation will be given on the grounds that particular wildlife was not seen or photographed.

 

7.  Travel Insurance — Mandatory Requirement
​

This is a fundamental condition of booking. It is a mandatory requirement that all clients hold adequate travel insurance before joining any Boswell Wildlife Photography tour, workshop, or one-to-one session. Failure to arrange insurance does not reduce your liability under these terms.

 

Your policy must provide adequate cover for each of the following:

​

  • Cancellation and curtailment of the trip for any reason

  • Medical and emergency expenses, including hospitalisation and repatriation

  • Personal accident, injury, and death

  • Loss of, damage to, or theft of luggage and personal possessions, including photographic equipment

  • Flight and travel delays or cancellations

  • Any additional risks specific to the destination (e.g. activity cover for boat travel, remote terrain)

 

Please ensure your policy covers the specific activities involved in your tour. Some standard travel policies exclude wildlife tours, boat trips, or activities in remote areas — please check your policy wording carefully before booking.

 

You are personally responsible for the management of any prescription medication. Please ensure you bring sufficient supplies for the full duration of the trip, plus a reasonable contingency in case of delays.

 

8.  Liability & Indemnity
​

Boswell Wildlife Photography is covered by public liability insurance appropriate to the activities offered. However, all activities on our tours, workshops, and one-to-one sessions are entered into at your own risk.

Boswell Wildlife Photography cannot accept liability for:

​

  • Loss of, or damage to, personal belongings or photographic equipment

  • Personal accident, injury, or illness sustained during a tour or workshop

  • Losses arising from circumstances beyond our reasonable control (force majeure)

  • Costs arising from flight delays, cancellations, or missed connections

  • Any consequential or indirect losses of any kind

 

Nothing in these Terms & Conditions seeks to limit liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

 

9.  Behaviour, Welfare & Wildlife Ethics
​

Boswell Wildlife Photography is committed to the welfare of wildlife and operates strictly within the law and applicable codes of conduct. All clients are expected to follow the instructions of the guide or leader at all times, particularly where wildlife welfare or safety is concerned.

​

We reserve the right to remove from a tour or workshop, without refund, any client whose behaviour endangers wildlife, disturbs protected species, or is detrimental to the experience of other participants.

10.  Health, Fitness & Medical Conditions
​

Some of our tours involve walking over uneven terrain, boat travel, early starts, and extended periods outdoors in challenging weather. It is your responsibility to ensure that you are fit and healthy enough to participate in the activities described for your chosen tour or workshop.

​

Please inform us at the time of booking of any medical conditions, mobility considerations, dietary requirements, or other needs that may affect your participation or that we should be aware of in the event of an emergency. This information will be treated in confidence and used only to assist us in providing appropriate support.

 

11.  Data Protection & Privacy
​

Boswell Wildlife Photography holds and processes your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Your personal information is collected solely for the purposes of managing your booking, communicating with you about your tour, and (with your consent) sending you information about future tours and offers.

​

We do not share, sell, or transfer your personal data to third parties for marketing purposes. Data is held securely and retained only for as long as is necessary for legal, administrative, or contractual purposes.

You have the right to request access to the personal data we hold about you, to request corrections, and to request deletion where there is no legitimate reason for us to continue to hold it. To exercise any of these rights please contact us via our website.

 

12.  Governing Law
​

These Terms & Conditions are governed by and construed in accordance with the laws of Scotland. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the Scottish courts.

 

 

 

13.  Amendments to These Terms
​

Boswell Wildlife Photography reserves the right to amend these Terms & Conditions from time to time. The version in force at the time of your booking will apply to your reservation. We recommend checking our website for the most current version before making a booking.
